In order to qualify for Social Security benefits, you must be found to be medically disabled based upon Social Security’s rules and regulations. In addition, to be eligible for SSI benefits, you must meet certain income and asset requirements.
To be found disabled, you must have a mental impairment, physical impairment or combination of medical conditions that have prevented you from performing substantial gainful activity for at least 12 months or are expected to keep you from performing substantial gainful activity for at least 12 months.
Your medical condition does not have to be included in Social Security’s Listed Impairments (aka “Listings”) to qualify.
YOU DO NOT HAVE TO BE OUT OF WORK FOR 12 months before filing for disability. Waiting until you have been out of work for one year to file for Social Security disability benefits is one of the biggest mistakes a person can make when starting a disability claim.
